Heights are made to order from 2 to 12 feet, 6 feet being the common pick, and the panels come with documented wind and fire ratings. Bay Area Fence Rules, Permits, and Codes
Do I need a permit for a fence in the Bay Area?
Often not, if you stay under the local height limit. In most Bay cities, a front-yard fence near 3 to 4 feet and a side or rear fence near 6 to 7 feet needs no permit; taller runs usually do. Numbers shift city to city, so verify with your local building department.
Height Limits in San Francisco, Oakland, and San Jose
San Francisco needs no permit up to 3 feet in front or 6 feet at the side and rear, and caps residential fences at 10 feet. Oakland sets its exemption by material: a non-masonry vinyl, wood, or metal fence is exempt up to 7 feet. San Jose allows 3 feet in front and 7 feet at the side before a permit applies.
Splitting a Shared Fence Under California Law
Statewide, a boundary fence is presumed a shared expense. Under the Good Neighbor Fence Act, Civil Code section 841, adjoining owners carry equal responsibility for the reasonable cost after 30 days’ written notice. Either owner can dispute an even split as unfair, and unresolved cases usually go to small claims.
Fencing a Pool to California Code
Around a pool, the barrier must stand 60 inches or taller, with no opening a young child could slip past and a self-latching gate that swings clear of the water. For a new or remodeled pool, two or more of the state’s seven drowning-prevention features are also required. Solid vinyl qualifies as a non-climbable barrier.
What about HOA rules and fire-zone codes?
Your HOA can set tougher limits than the city, and where it does, its rule governs. Many lay out which styles, heights, and colors are allowed and want written approval first, so read your CC&Rs early. Some fire-zone cities also limit combustible fencing near a home, where aluminum counts as a noncombustible material, though details vary.
